Terms of Use — GROUNDED

These Terms of Use ("Terms") govern your use of the GROUNDED mobile application ("the App"), operated by Lidia Markovic, trading as LM Wellness (ABN 48 440 407 031), based in Australia ("we", "us", "our").

By creating an account or using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. What GROUNDED is — and what it is not

GROUNDED provides guided audio sessions, journaling tools, daily check-ins, challenges, and related wellbeing content designed to support nervous system regulation and everyday emotional wellbeing.

The App is educational and wellbeing-focused only. It is not medical or psychological treatment. It is not a substitute for diagnosis, therapy, counselling, or care from a qualified health professional. Lidia Markovic is a certified CTC Master Therapist; she is not a doctor, psychologist, or licensed mental health clinician, and she does not offer any professional health or medical advice. Nothing in the App should be taken as medical or psychological advice.

If you are experiencing a mental health crisis, please seek immediate help. In Australia: Lifeline 13 11 14, or 000 in an emergency.

By using the App you acknowledge that you are responsible for your own wellbeing decisions and that you should consult a qualified professional for any medical or mental health concerns.

2. Eligibility

You must be 18 years or older to use the App. By creating an account you confirm that you are at least 18. We may suspend or delete accounts that we reasonably believe belong to users under 18.

3. Your account

You are responsible for keeping your login credentials secure and for all activity under your account. Please tell us promptly at l.m.wellness@outlook.com if you believe your account has been accessed without authorisation.

You may delete your account at any time within the App (Me → Delete account). Deletion is permanent and removes all your content.

4. Subscriptions and payments

Free content. Some sessions and features (including challenges) are available free of charge.

Premium subscription. Additional sessions and features require a paid subscription:

• Monthly — billed monthly

• Annual — billed yearly, with a 7-day free trial

Prices are shown in the App at the time of purchase and are charged in your local currency through your Apple ID.

Billing and renewal. Subscriptions are processed by Apple. Your subscription automatically renews unless cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription at any time in your device Settings → Apple ID → Subscriptions. If you cancel during a free trial, you will not be charged.

Refunds. Purchases are processed by Apple, and refund requests are handled through Apple (reportaproblem.apple.com). Nothing in these Terms limits your rights under the Australian Consumer Law.

5. Acceptable use

You agree not to:

• Use the App for any unlawful purpose

• Attempt to access another person's account or data

• Reverse engineer, copy, resell, or redistribute the App or its content

• Interfere with the App's operation or security

We may suspend or terminate accounts that breach these Terms.

6. Intellectual property

All content in the App — including audio sessions, scripts, text, challenge content, images, and branding — is owned by or licensed to LM Wellness and is protected by copyright. You are granted a personal, non-transferable, non-exclusive licence to use the App and its content for your own personal, non-commercial use. Content you create in the App (such as journal entries) remains yours.

7. Availability and changes

We work to keep the App available and improving, but we do not guarantee uninterrupted access. We may add, change, or remove features (including content and challenges) over time. We may update these Terms; if we make material changes we will notify you through the App or by email, and continued use after changes take effect constitutes acceptance.

8. Disclaimers and liability

To the maximum extent permitted by law:

• The App is provided "as is" without warranties beyond those that cannot be excluded under the Australian Consumer Law.

• We are not liable for indirect or consequential loss arising from your use of the App.

• Nothing in these Terms excludes, restricts, or modifies any consumer guarantee or right you have under the Australian Consumer Law or other laws that cannot be excluded. Where liability can be limited, our liability is limited to re-supplying the relevant service or the cost of re-supplying it.

You acknowledge that wellbeing outcomes vary between individuals and that the App does not promise any particular result.

9. Governing law

These Terms are governed by the laws of the Australian Capital Territory, Australia. You submit to the non-exclusive jurisdiction of the courts of that territory.
